MARYLAND CRIMINAL AND MVA PENALTIES FOR DRIVING UNDER THE INFLUENCE OF ALCOHOL AND/OR DRUGS Transportation Article 21-902

Punishments The statutory punishment for a DUI conviction can be very severe. All of the penalties listed below are within the Court’s discretion:

These penalties do not include any suspension that may be carried out independently by the MVA.

FIRST OFFENSE One (1) year in jail, twelve (12) points, $1,000 fine, and supervised probation up to three (3) years (at a cost of $1,200 per year). As a result of the court conviction, the MVA will seek to suspend or revoke your license.

SEPARATE MVA PENALTIES For taking a test and the result is .08 or over, but under .15, then forty five (45) day suspension. For a result .15 or higher, then ninety (90) day suspension. For a refusal, suspension of four (4) months.

SECOND OFFENSE Same as above but the jail is increased to Two (2) years.

THIRD OFFENSE AND MORE Same as above but the jail is increased to three (3) years.

DRIVING WHILE IMPAIRED

FIRST OFFENSE Sixty (60) days in jail, 8 points, $500 fine and supervised probation up to three (3) years. As a result of a court conviction the MVA will seek to suspend your license. SEPARATE MVA PENALTIES: For taking a test and the result is .08 or over, but under .15, then forty five (45) day suspension. For a result .15 or higher, then ninety (90) day suspension. For a refusal, suspension of four (4) months.

SECOND OFFENSE Same as above but nne (1) year in jail.

THIRD OFFENSE Same as above but two(2) years in jail.
